  • 650 Avenue Samson, Rivière-Beaudette, Quebec J0P 1R0, Canada

Property owners / Hosts ("Owners"): Cédric Leboeuf and Karine Loiselle

Family Members: Cédric Leboeuf, Karine Loiselle, Arielle Leboeuf, Loralie Leboeuf, and Gabrielle Leboeuf.

This Agreement is signed by the person named in the signature block ("I", "me"), for myself and, if I list any children, as the parent or legal guardian of each listed child. It applies whether I am on the PROPERTY as a guest or visitor, as a parent who stays with a child, as a parent who drops off a child, as an employee or worker, or as a contractor or service provider, and to every visit, event, gathering, stay, or work day. The answers I give on the signing form (including my role, my children, whether I stay or drop off, the activities I allow, and my insurance information) are part of this Agreement.

Important warning — please read before signing

A SIGNED AGREEMENT IS A CONDITION OF ENTRY FOR EVERY PERSON: GUESTS, PARENTS, CHILDREN, EMPLOYEES, WORKERS, AND CONTRACTORS. ANY PERSON WHO IS NOT COVERED BY A SIGNED AGREEMENT IS NOT PERMITTED ON THE PROPERTY AND WILL BE TREATED AS A TRESPASSER.

THE MAIN PROPERTY AT 752 OVERIVER DR IS A PRIVATE WATERFRONT PROPERTY WITH AN UNFENCED SWIMMING POOL WITH A DIVING BOARD AND DIRECT ACCESS TO A RIVER WITHOUT PROTECTIVE CHILD-SAFETY BARRIERS. IT ALSO HAS BOATS, A DOCK, TRAMPOLINES, AND GAS AND ELECTRIC MOTORCYCLES. EVERY OTHER PROPERTY MAY HAVE SIMILAR HAZARDS, INCLUDING POOLS, WATERFRONT, AND MOTORIZED EQUIPMENT.

NO LIFEGUARD, PROFESSIONAL WATER SAFETY SUPERVISOR, INSTRUCTOR, OR PROFESSIONAL CHILDCARE PROVIDER WILL BE PRESENT.

ACCIDENTS INVOLVING WATER, VEHICLES, RECREATIONAL EQUIPMENT, TOOLS, OR OTHER PROPERTY MAY RESULT IN SERIOUS INJURY, PERMANENT DISABILITY, DROWNING, OR DEATH.

EVERY ADULT IS RESPONSIBLE FOR THEIR OWN SAFETY. A PARENT OR LEGAL GUARDIAN WHO BRINGS A CHILD MUST EITHER STAY AND SUPERVISE THE CHILD (SECTION 5) OR COMPLETE THE DROP-OFF CONSENT (SECTION 6). A CHILD MAY ONLY DO THE ACTIVITIES THE PARENT HAS ALLOWED (SECTION 7).

1. Definition of property and equipment

For purposes of this Agreement, the term "PROPERTY" means each of the following premises, together with its grounds, waterfront, docks, structures, facilities, and common areas:

(a) the private residence located at 752 Overiver Dr, North Fort Myers, FL 33903, USA;

(b) the property located at 1511 SE 12th Ct, Deerfield Beach, FL 33441, USA;

(c) the property located at 650 Avenue Samson, Rivière-Beaudette, Quebec J0P 1R0, Canada; and

(d) every other house, condominium, apartment, cottage, lot, land, dock, or other real property, wherever located, now or in the future, that is owned, co-owned, leased, rented, occupied, or controlled, directly or indirectly, by Cédric Leboeuf, Karine Loiselle, Arielle Leboeuf, Loralie Leboeuf, or Gabrielle Leboeuf (each a "Family Member"), including through any trust of which a Family Member is a settlor, trustee, or beneficiary, and through any corporation, partnership, limited liability company, or other entity in which a Family Member holds an interest or which a Family Member controls.

PROPERTY also includes all real and personal property, possessions, vehicles, watercraft, equipment, recreational items, and belongings owned, leased, possessed, operated, or controlled, directly or indirectly, by any Family Member or by any such trust or entity, that are located at any of these premises or made accessible in connection with any visit, event, or work. Every provision of this Agreement applies to each of these premises, including any pool, river, canal, lake, or other body of water there.

PROPERTY includes, but is not limited to:

  • Swimming pools, diving boards, spas, and water features.
  • The river, shoreline, seawalls, docks, boat lifts, and waterfront structures.
  • Boats, personal watercraft, e-foils, kayaks, paddleboards, and other marine equipment.
  • Cars, trucks, and other motor vehicles.
  • Golf carts, gas and electric motorcycles and dirt bikes, and other motorized recreational vehicles.
  • Bicycles, e-bikes, scooters, skateboards, and riding equipment.
  • Trampolines, toys, children's recreational equipment, and play structures.
  • Water slides, inflatable slides, bounce houses, and other inflatable equipment.
  • Sports equipment, outdoor furniture, tools, machinery, and other household possessions.
  • Any other equipment, object, structure, vehicle, watercraft, or personal property, whether specifically identified in this Agreement or not.

The presence of any item on the PROPERTY does not constitute permission to operate, ride, enter, or use it. No person may operate or use the Owners' boats, motor vehicles, golf carts, motorcycles, or other powered equipment without an Owner's express permission. A child may take part in such an activity only if their parent or guardian has marked it Allowed under Section 7, under the conditions stated there, and only when an Owner permits it at the time.

In this Agreement, "my child" means each minor child listed in this Agreement. Provisions about children apply only if I list a child, and then apply to each listed child.

2. Condition of entry — no trespassing

Permission to enter or remain on the PROPERTY is granted only to persons covered by a signed Agreement. Every adult, including guests, parents, employees, workers, and contractors, must sign this Agreement for themselves. A child may enter the PROPERTY only if a parent or legal guardian has signed this Agreement for that child and either (a) stays on the PROPERTY with the child under Section 5, or (b) has completed the drop-off consent under Section 6.

Any person who has not signed, or who is not covered by, a signed Agreement is not authorized to enter or remain on the PROPERTY, is present without the Owners' permission, and will be treated as a trespasser. Such a person may be required to leave the PROPERTY immediately.

Because the swimming pool and waterfront are not fenced, a child may be on the PROPERTY only if their parent or legal guardian allows the child to swim in the pool. A child who is not allowed to swim is denied access.

The Owners may refuse or revoke permission to be on the PROPERTY at any time and for any reason.

3. Disclosure of property conditions

I acknowledge that the PROPERTY and its facilities are a private residence used for private visits, gatherings, and work in their existing condition.

I expressly understand and acknowledge that:

A. The property directly borders a river without protective barriers preventing children from accessing the waterfront.

B. The swimming pool does not have a dedicated protective child-safety fence or barrier enclosing it.

C. No lifeguard or professional water safety personnel will be present.

D. The Owners are not a childcare provider, camp, school, instructor, or coach.

E. Boats, vehicles, golf carts, motorcycles, bicycles, trampolines, toys, slides, tools, and other equipment may be present and may create risks of injury, even when not being used.

F. Accidents may occur from touching, climbing on, falling from, entering, approaching, or improperly using any part of the PROPERTY or its equipment.

G. Children may accidentally enter the swimming pool or river, even if they do not intend to swim.

H. The Owners have several boats and personal watercraft, several gas and electric vehicles (including electric motorcycles, dirt bikes, e-bikes, scooters, and golf carts), and other potentially dangerous equipment, machinery, and tools.

I. Hazardous products may be present anywhere on the PROPERTY, including pool chemicals, fuel, oil, lithium batteries and chargers, cleaning products, paints, solvents, pesticides, and fertilizers.

J. Safety equipment on the boats, watercraft, and vehicles, such as life jackets, fire extinguishers, signaling devices, engine cut-off lanyards, lights, first-aid kits, helmets, and protective gear, may be missing, incomplete, worn, expired, or not the right size for a particular person.

K. The PROPERTY, boats, vehicles, equipment, and devices may not be maintained, inspected, serviced, updated, or repaired, and may have defects or be subject to recalls that the Owners do not know about.

L. AS IS. Everything at the PROPERTY is made available "AS IS", in its existing condition, without any warranty or promise of safety, fitness, maintenance, or compliance. The Owners have no duty to inspect, maintain, update, or equip anything for my benefit beyond what the law requires.

I acknowledge that these hazards may result in serious bodily injury, permanent disability, drowning, burns, poisoning, or death.

4. Personal responsibility of every adult

I agree:

  1. To take reasonable care for my own safety and the safety of others, and to follow the Owners' instructions and any posted rules.
  2. Not to use or operate any boat, vehicle, golf cart, motorcycle, powered equipment, or recreational equipment belonging to the Owners without their express permission, and, if permitted, to use it within my ability, with the required protective gear, and only in the designated areas.
  3. Not to enter the river, dive or jump from the dock or seawall, or use the docks or boat lifts without the Owners' express permission.
  4. If I consume alcohol, to do so responsibly and at my own risk, not to provide alcohol to any person under 21, and not to operate any vehicle, watercraft, or equipment while impaired.
  5. To be responsible for loss of or damage to the PROPERTY, any vessel, vehicle, or equipment caused by my negligence, misuse, or unauthorized use, including any insurance deductible, to the extent permitted by law.
  6. To leave the PROPERTY immediately if the Owners ask me to.

5. Children whose parent stays — mandatory parental supervision

If I list a child and I indicate that I will stay at the PROPERTY, as the parent or legal guardian of that child I agree:

  1. To remain physically present on the PROPERTY during my child's entire attendance.
  2. To personally provide continuous, direct, and active supervision of my child.
  3. Not to leave my child unattended, and not to assume that the Owners, their family members, entertainers, workers, or other guests will supervise my child.
  4. To prevent my child from accessing hazardous areas or equipment, and from any activity I have not marked Allowed under Section 7.
  5. To maintain immediate supervision whenever my child approaches the swimming pool, waterfront, slides, trampolines, or recreational equipment.
  6. To immediately intervene whenever my child engages in unsafe behavior.

I ACKNOWLEDGE THAT, WHILE I AM PRESENT, THE OWNERS ARE NOT PROVIDING BABYSITTING SERVICES, LIFEGUARD SERVICES, OR DEDICATED CHILD SUPERVISION.

If I leave the PROPERTY without my child, I must first complete the drop-off consent in Section 6 by signing a new Agreement.

6. Children dropped off without their parent — drop-off consent

If I list a child and I indicate that I will leave my child at the PROPERTY without staying ("drop-off"), I agree as follows.

6.1 Please read — this is different from a normal playdate. The main PROPERTY at 752 Overiver Dr is on the Caloosahatchee River with a dock, boats, a pool with a diving board, trampolines, and gas and electric motorcycles and other motorized equipment that the Owners' own children use. Every other PROPERTY may have a pool, waterfront, or similar equipment. My child may be invited to take part in these activities. The Owners will apply their family rules and provide the general adult supervision of a private family hosting a child's friend, but they are not instructors, coaches, lifeguards, or professional caregivers, and they cannot promise one-on-one supervision at every moment. I decide, activity by activity, what my child may do (Section 7). I may also simply decline the visit.

6.2 House rules. My child must follow the Owners' family rules and instructions. The Owners may stop any activity or end the visit at any time, and I, or the pick-up person I named, will come promptly when asked.

6.3 Information and contact. The information I gave about my child's age, health, allergies, medications, swimming ability, and experience is accurate and complete. I will keep my phone on during the visit and will tell the Owners right away about any change.

6.4 Parent's own release. TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, I, ON MY OWN BEHALF AND ON BEHALF OF MY SPOUSE, HEIRS, AND ESTATE, RELEASE AND AGREE NOT TO SUE THE RELEASED PARTIES (SECTION 11) FOR ANY CLAIM I MAY PERSONALLY HAVE ARISING FROM MY CHILD'S PRESENCE AT THE PROPERTY OR PARTICIPATION IN AN ACTIVITY I ALLOWED, INCLUDING CLAIMS FOR MEDICAL EXPENSES, LOSS OF SERVICES, COMPANIONSHIP OR CONSORTIUM, AND EMOTIONAL DISTRESS, WHETHER CAUSED BY THE CONDITION OF THE PROPERTY OR EQUIPMENT OR BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY.

6.5 Indemnity. To the fullest extent permitted by Florida law, I agree to indemnify and hold harmless the Released Parties from any claim brought by or on behalf of my child, or by any third party, arising from my child's participation in an activity I allowed, my child's breach of the rules, my child's use of any equipment without an Owner's permission, or inaccurate information I have given.

6.6 Damage. I am responsible for damage my child causes to the PROPERTY, any vessel, motorcycle, bike, or equipment, or to another person's property, through misuse, unauthorized use, or disregard of the rules, including any insurance deductible.

6.7 This section does not cover gross negligence or intentional misconduct, or any liability that cannot be released under Florida law. Nothing here prevents my child from receiving emergency care.

7. Activities — the parent's choices

For every child I list, whether I stay or drop off:

  1. Swimming pool. Every child at the PROPERTY must be allowed to swim in the pool (Section 2). A sober adult must be in the pool area whenever children swim, and a weak or non-swimmer must wear a life jacket in or near the water.
  2. Other activities. On the signing form I marked each activity below as Allowed or not. My choices are recorded with my signature and are part of this Agreement. Any activity I did not mark Allowed is refused, and the Owners will not allow it.
  3. An activity marked "16+ only" applies only to a listed child who is 16 or older. The manufacturer's age and size rating is always a minimum.
  4. Even when allowed, an activity takes place only when an Owner permits it at the time, and always under the conditions below.
  5. I may change my choices at any time by text or email to an Owner.
ActivityConditions that always apply

8. Employees and workers

This section applies if I am on the PROPERTY to work as an employee or worker.

  1. I will be on the PROPERTY only for my work and in the areas needed for it. I will not use the swimming pool, river, docks, boats, vehicles, golf carts, motorcycles, or recreational equipment unless an Owner expressly allows it.
  2. I will use safe work practices and appropriate protective equipment, keep my work area safe for others, including children, and tell the Owners about any hazard I notice.
  3. I will report any injury, however minor, to an Owner the same day.
  4. If I am paid by a company or agency, that company or agency is my employer and is responsible for my wages, taxes, and any workers' compensation coverage required by law.
  5. Nothing in this Agreement waives or reduces any right to workers' compensation benefits, or any other right that cannot be waived by law.

9. Contractors and service providers

This section applies if I am on the PROPERTY as, or on behalf of, an independent contractor or service business (the "Service Provider"). I sign for myself and, with authority, for the Service Provider.

9.1 Access and conduct. The Service Provider, its workers, subcontractors, and anyone it brings ("Provider Parties") may enter only the areas reasonably needed for the work, during hours agreed with the Owners. No Provider Party will use, enter, board, operate, or touch the pool, spa, dock, seawall, boat lifts, vessels, vehicles, motorcycles, e-bikes, trampolines, tools, or other equipment of the Owners unless the work requires it and an Owner authorizes it. No swimming, fishing, or entering the river or pool. No alcohol, cannabis, or illegal drugs, and no work while impaired. No firearms. No smoking or vaping except where the Owners allow. No children, friends, or animals of Provider Parties on the PROPERTY.

9.2 Safety. The Service Provider is responsible for safe work methods, protective equipment, the condition and safe use of its tools, ladders, equipment, chemicals, and materials, and for keeping its work area safe and secured, especially from children. It will tell the Owners at once about any hazard it creates or finds.

9.3 Every person signs. Every individual Provider Party must sign their own Agreement before first entering the PROPERTY. The Service Provider will not bring any unlicensed person or any worker not covered by workers' compensation as required by Florida law, and will not subcontract any part of the work without the Owners' consent.

9.4 Insurance. Unless the Owners agree otherwise in writing, the Service Provider will maintain: (a) commercial general liability insurance of at least $1,000,000 per occurrence; (b) workers' compensation coverage for all workers as required by Florida law, or a valid exemption; and (c) automobile liability insurance for any vehicle brought onto the PROPERTY. It will give the Owners a certificate of insurance before the first work visit and at each renewal, and will name the Owners as additional insureds on request. The insurance information given on the signing form is accurate.

9.5 Injuries. If any Provider Party is injured at the PROPERTY, the Service Provider will report it to the Owners in writing within 24 hours and will pursue the claim through its own workers' compensation or other insurance.

9.6 Damage. The Service Provider is responsible for all loss or damage to the PROPERTY, landscaping, pool, dock, lifts, vessels, vehicles, equipment, and personal property caused by any Provider Party, including insurance deductibles, and will repair or reimburse promptly.

9.7 Indemnity. To the fullest extent permitted by law, the Service Provider will defend, indemnify, and hold harmless the Released Parties from claims, damages, and costs, including reasonable attorney's fees, arising from the work, the acts or omissions of any Provider Party, or any breach of this Agreement, except to the extent caused by the gross negligence or willful misconduct of a Released Party. For construction-type work, this indemnity is limited as required by Florida law.

9.8 Payment and liens. The Service Provider will pay its subcontractors, suppliers, and workers when due, will deliver lien releases on request as a condition of payment, and will remove or bond off any lien recorded against the PROPERTY within 10 days of notice, at its cost.

9.9 Relationship. The Service Provider is an independent contractor, not an employee or agent of the Owners. Any separate written contract continues to govern price and scope of work. This Agreement governs access, safety, risk, insurance, and liability at the PROPERTY and prevails over any conflicting term in the Service Provider's quotes, invoices, or terms and conditions.

9.10 Nothing in this Agreement waives or reduces any right to workers' compensation benefits, or any other right that cannot be waived by law.

10. Assumption of risk

I knowingly and voluntarily choose to enter the PROPERTY for any visit, event, or work, and, if I list a child, to allow that child to be on the PROPERTY and take part in the activities I allowed, after being informed of the risks described in this Agreement.

These risks include, without limitation:

  • Accidental drowning or near-drowning.
  • Falls into the swimming pool or river, and diving injuries.
  • Injuries involving boats, towed water sports, personal watercraft, docks, or waterfront structures.
  • Injuries involving motorcycles, dirt bikes, golf carts, bicycles, automobiles, or other vehicles, including falls, collisions, and burns.
  • Injuries involving trampolines, toys, slides, inflatables, and recreational equipment.
  • Injuries while performing work, including from tools, ladders, heights, electricity, chemicals, heat, and weather.
  • Slips, falls, collisions, cuts, fractures, and head or spinal injuries.
  • Injuries caused by other guests, workers, or participants.
  • Permanent physical injury, disability, or death.

I recognize that not every potential danger can be identified or anticipated.

I VOLUNTARILY ACCEPT THE DISCLOSED RISKS ASSOCIATED WITH MY OWN PRESENCE, ACTIVITIES, AND WORK ON THE PROPERTY AND, ON BEHALF OF MY CHILD, THE RISKS OF THE ACTIVITIES I ALLOWED.

11. Release and waiver of liability

PLEASE READ CAREFULLY — THIS SECTION AFFECTS IMPORTANT LEGAL RIGHTS.

The "RELEASED PARTIES" are the Family Members (Cédric Leboeuf, Karine Loiselle, Arielle Leboeuf, Loralie Leboeuf, and Gabrielle Leboeuf); their children, parents, siblings, and other relatives; members of their household and their guests; every trust that owns, holds, or controls any PROPERTY, vessel, vehicle, or equipment, or of which a Family Member is a settlor, trustee, or beneficiary, together with its trustees and beneficiaries; every corporation, partnership, limited liability company, or other entity that holds title to or controls any PROPERTY, or owns any vessel, vehicle, or equipment kept or used there; and their respective directors, officers, employees, agents, insurers, successors, and assigns.

In consideration of permission to enter the PROPERTY and be there for any visit, event, or work, I agree, to the fullest extent permitted under applicable Florida law, to release, discharge, and not sue the RELEASED PARTIES for claims that I personally may have for injuries, death, or property damage arising out of or relating to presence on the PROPERTY, any visit, event, activity, or work there, the condition of the PROPERTY, or the use of or proximity to any property, equipment, vehicle, watercraft, toy, structure, or recreational facility described herein.

I UNDERSTAND THAT THE RELEASED PARTIES ARE NOT PROFESSIONALS, THAT THEY MAY MAKE MISTAKES, AND THAT THEY MAY BE NEGLIGENT. I EXPRESSLY ACCEPT THAT POSSIBILITY. This release expressly includes claims based upon the NEGLIGENCE of any RELEASED PARTY, including negligent maintenance, inspection, repair, or equipping of the PROPERTY, boats, vehicles, or equipment; missing, defective, or outdated safety equipment; negligent supervision, instruction, or operation; negligent failure to warn; and the presence of hazardous products, to the fullest extent such claims may legally be released.

Covenant not to sue. I agree that I will have no recourse against the RELEASED PARTIES for any released claim, and I will not bring or join any claim, lawsuit, or proceeding against them for it. If I do, I will pay the RELEASED PARTIES' reasonable attorney's fees and costs of defending it, to the extent permitted by law.

To the extent permitted by applicable Florida law, I also intend to waive and release claims that I am legally authorized to waive on behalf of each child I list.

Nothing in this Agreement is intended to release gross negligence, reckless or intentional misconduct, or any claim or legal obligation that cannot lawfully be waived or released.

I understand that signing this Agreement does not automatically eliminate the legal responsibilities of the property owners or other RELEASED PARTIES.

12. Water and recreational safety

I acknowledge and agree that:

  • No child I list may enter the river, use the docks, boats, or boat lifts, or take part in any water or motorized activity unless I marked it Allowed under Section 7, and then only under its conditions.
  • Each child I list is allowed to swim in the swimming pool. A child who is not allowed to swim may not be on the PROPERTY.
  • A child unable to swim independently must wear a life jacket and remain within arm's reach of a responsible supervising adult when in or near the water.
  • No one may dive or jump into the river, or from the dock or seawall.
  • Recreational equipment shall only be used when appropriate for a person's age and abilities and with appropriate supervision.
  • If I stay with my child, I am responsible for stopping any unsafe behavior by my child.

I UNDERSTAND THAT NO LIFEGUARD WILL BE PRESENT AND THAT FLOTATION DEVICES DO NOT REPLACE ADULT SUPERVISION.

13. Emergency medical authorization

I authorize the Owners to contact emergency medical services, including 911, if an accident or medical emergency occurs.

If I am injured or ill and unable to consent, or if a child I list is injured or ill and I cannot be reached immediately, I authorize Cédric Leboeuf, Karine Loiselle, or any adult acting for them to obtain emergency medical care, ambulance or other transportation, and hospital treatment, to share the medical information I provided with responders, and to consent to treatment the treating physician considers necessary, to the extent permitted by law. I will pay all medical and transportation costs and reimburse the Owners for any cost they advance. The Owners will contact me as soon as reasonably possible.

14. Scope, duration, governing law, and severability

This Agreement applies to the occasion identified above and to every visit, stay, gathering, event, or work day at the PROPERTY by me or by any child listed in this Agreement, whether or not it is an organized event, until I revoke it in writing to the Owners. A newer Agreement I sign replaces my earlier choices.

This Agreement shall be governed by and interpreted under the laws of the State of Florida. Any dispute will be brought only in the courts located in Lee County, Florida. To the extent permitted by law, I WAIVE TRIAL BY JURY.

If any provision is found invalid or unenforceable, the remaining provisions shall continue in effect to the extent permitted by law.

For a PROPERTY located outside Florida, including in Quebec, this Agreement applies to the fullest extent permitted by the law of the place where that PROPERTY is located. Any provision that law does not permit is limited to the extent necessary, and the rest of this Agreement, including the condition of entry, the disclosures, and the assumption of risk, continues to apply.

This Agreement is written in English. I read English, or this Agreement has been explained to me in a language I understand, and I have had the chance to ask questions.

15. Signer's certification

I certify that I am at least 18 years old and legally able to sign this Agreement. If I list any child, I certify that I am that child's parent or legal guardian and that I have the legal authority to sign this Agreement on the child's behalf. If I sign for a Service Provider, I certify that I have authority to bind it.

16. Electronic signature

I agree to sign this Agreement electronically. My electronic signature has the same legal effect as my handwritten signature. I may request a paper copy of this Agreement from the Owners at any time.
